The subpages to which this Agreement applies are published and maintained by Atwater Forge (“AtwaterForge”, “atwaterforge”). The websites and properties of affiliated Atwater Forge companies, including some that are linked to/from this Website, may have different terms and conditions and other policies; therefore, please review the terms and conditions and other policies on those websites or properties if you visit them.
This Agreement affects your legal rights. It governs your rights and responsibilities in connection with, and applies to, this Website, and when you access, browse, or use this Website, you accept, without limitation or qualification, this Agreement, as set forth herein and below and, you agree to be bound by this Agreement without limitation or qualification, including the terms and conditions set forth in the Privacy Policy, and is hereby incorporated into this Agreement. If at any time you do not accept this Agreement, stop using the Website. You also agree to abide by all local, state, federal and international laws and regulations applicable to your use of this Website.
Atwater Forge reserves the right, in its sole discretion, to make changes to this Agreement, without notice and without liability. Changes to this Agreement will be effective when posted. Your use of this Website after Atwater Forge posts any changes to this Agreement will be considered your acceptance of those changes and will constitute your agreement to be bound thereby.

This Website is only for your personal use. You may not distribute, exchange, modify, sell or transmit anything you copy from this Website, including but not limited to any text, images, audio and video, for any business, commercial, or public purpose. Atwater Forge’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Atwater Forge reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Atwater Forge in asserting any available defenses, and you shall not in any event settle any matter without the written consent of Atwater Forge.

Miscellaneous
Controlling Law; Lawsuits. This Agreement shall be governed by and construed according to the laws of the State of Illinois as applied to agreements made, entered into and performed entirely in Illinois. You agree that any disputes or legal proceedings arising out of or related to this Website shall be brought in the state or federal courts in the State of Illinois, and shall be handled individually without any class action. You also agree that notwithstanding any statute or law to the contrary, any claim or cause of action arising out of, or related to, the use of this Website or this Agreement must be filed within one (1) year after the claim or cause of action arose or be forever barred.
Court Orders and Subpoenas. Atwater Forge will comply with all court orders and subpoenas and cooperate with investigations by local, state and federal agencies. Under these circumstances, your use of this Website may be shared with others with or without such your knowledge or consent.
Complete Agreement/Invalidity & Severability. This Agreement and any additional terms posted on this Website together constitute the complete, final and exclusive understanding and agreement between you and Atwater Forge relating to the subject matter hereof and your use of this Website, superseding all prior or contemporaneous understandings, agreements, communications, and / or advertising with respect to such subject matter. If for any reason any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, and all other provisions shall remain in full force and effect. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.
No Waiver. Atwater Forge’s failure to insist upon strict performance of any provision(s) of this Agreement or to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of its right or remedies or of the provision.
Assignment. Atwater Forge may assign its rights and delegate its duties under this Agreement to any
party at any time without notice to you. The rights and licenses granted hereunder may not be assigned or transferred by you, and any attempted assignment or transfer in violation hereof shall be null and void.
Headings. All headings in this Agreement are for convenience only and have no legal effect.

RETURNS / EXCHANGES
Thanks for purchasing from atwaterforge.com.
Due to the nature of our business and products we sell, prior authorization must be obtained before a return or exchange is authorized.
For items to be eligible for a refund, you must initiate the return within 7 calendar days of receipt (this will be the date shown by USPS as “delivered”). The item must in its original condition. If you have questions – please email atwaterforge@gmail.com to begin the process.
Unfortunately all custom orders are non-returnable/refundable unless the custom nature of the product contains a misspelling (for engraving). Please be absolutely certain that the custom option you choose is correct prior to placing your order. Understand too that images on the website are for representation only – each piece is individually forged by one person (me), so there will be slight variations in each piece produced, whether that is shown in hammer impressions in metal forgings, or in wood grain for products that include wood, nothing will be identical because each piece is individually produced.
